These Terms of Service govern your use of the GKScholarship website (the "Site"). By using this website (the "Site"), you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Notice, and any additional terms and conditions that are referenced herein or that otherwise may apply to specific sections of the Site, or to products and services that we make available to you through the Site (all of which are deemed part of these Terms of Service). Accessing the Site, in any manner, whether automated or otherwise constitutes use of the Site and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website and update the "Last Updated" date to reflect the date of the changes. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.
Rights and Restrictions Relating to Site Content.
Your Limited Right to Use Site Materials. This Site and all the materials available on the Site are the property of us and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. Our Right to Use Materials You Submit or Post. When you submit or post any material (including any photos or videos) via the Site, you grant us, and anyone authorized by us, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, sell, exploit, create derivative works from, distribute, and/or publicly perform or display such material, in whole or in part, in any manner or medium (whether now known or hereafter developed), for any purpose that we choose. The foregoing grant includes the right to exploit any proprietary rights in such posting or submission, including, but not limited to, rights under copyright, trademark or patent laws that exist in any relevant jurisdiction. Also, in connection with the exercise of these rights, you grant us, and anyone authorized by us, the right to identify you as the author of any of your postings or submissions by name, e-mail address or screen name, as we deem appropriate. You understand that the technical processing and transmission of the Site, including content submitted by you, may involve transmissions over various networks, and may involve changes to the content to conform and adapt it to technical requirements of connecting networks or devices. You will not receive any compensation of any kind for the use of any materials submitted by you.
Limitations on Linking and Framing. You are free to establish a hypertext link to our Site so long as the link does not state or imply any sponsorship of your website or service by GKScholarship. However, you may not, without our prior written permission, frame or inline link any of the content of our Site, or incorporate into another website or other service any of our material, content or intellectual property.
Age Restriction.
GKScholarship is not directed to children under the age of 13. GKScholarship prohibits registration by and will not knowingly collect personally identifiable information from anyone under 13.
About our Programs.
Our scholarship program is intended for residents in the United States only and shall be construed and evaluated according to the laws of the United States. If you do not meet these requirements, we ask that you not apply. Our program is NOT sponsored by, or endorsed by any college, school, corporation or government entity.
Scholarship Eligibility. This scholarship is open to any current high school student, college student, graduate school student or returning adult student. Applicants must be permanent residents of the United States. Employees, officers, and directors of GKScholarship (Sponsor) and its related companies and members of the immediate family and household of each are not eligible. By participating in the scholarship competition, you fully and unconditionally agree to and accept these Terms and the decisions of Sponsor, which are final and binding. Void outside of the U.S. and where prohibited by law.
Entry. To apply, complete the online application. Registration is free. Each applicant may enter the scholarship once during each registration time frame. GKScholarship is not responsible for errors, omissions, lost, late, interruptions, deletions, delays in operations or transmission, invalid, incomplete, technically corrupted or misdirected entries. All of these types of entries will be disqualified. All entries become the property of GKScholarship and will not be returned. GKScholarship is not responsible for any claims, liabilities or damages in conjunction with the prize of the scholarship. GKScholarship is not responsible for any claims, liabilities or damages in conjunction with the process of meeting the scholarship rules. GKScholarship reserves the right to disqualify entrants for any reason we deem fit and at any time. Scholarship rules, dates, deadlines, award amounts and guidelines are subject to updates and/or modifications at any time and for any reason.
Select and Notification. Winners will be selected by a judging panel administered by GKScholarship. The decision of this panel is final. The use of the data and personal information will be in compliance with our general privacy policy. The potential winner will be notified by e-mail within approximately seven (7) business days of the selection. If a potential winner cannot be contacted after reasonable effort within seven (14) days after the first attempt to contact him/her, this will result in forfeiture of the prize. The scholarship monies will be paid directly to the winner upon verification that the winner applied. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. The scholarship may be tax free if the recipient meets all IRS requirements. Prize is awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. If the winner chooses not to accept his/her prize, an alternate winner may be chosen. The award will be paid in one lump sum to the winner of the scholarship.
Disputes. This scholarship is governed by the laws of the United States without respect to conflict of law doctrines. As a condition of participating in this scholarship, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this scholarship, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the U.S. having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
Limitations of Liability. By participating, entrants (a): agree that the Sponsor, and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or scholarship shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this scholarship, including entry and participation in this scholarship and acceptance, possession, use or misuse of the prizes; (b) agree that Sponsor and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (c) agree to be bound by the official rules and the decisions of the Sponsor (including but not limited to eligibility determinations) which are final and binding in all respects; and (d) consent to use of his/her name, photograph and/or likeness for advertising and promotional purposes in connection with this scholarship without additional compensation, unless prohibited by law.
All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this scholarship, they will indemnify Sponsor from any and all such claims, including the attorneys' fees related thereto. Sponsor shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, illegible, mutilated, incorrect or incomplete, and such entries will be not be eligible for this scholarship. Sponsor is not responsible for late, lost, incomplete, inaccurate or misdirected entries, whether caused by any technical or human error which may occur in the processing of the entries in the scholarship; computer system, phone line, computer equipment or computer malfunctions, software, program malfunctions or other failures, or other errors or delays; or network connections that are human, mechanical or technical in nature. Entrant further agrees that in any cause of action, Sponsor and its employees' and agents' liability will be limited to the cost of entering and participating in the scholarship, and in no event shall the released parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. ANY PERSON ATTEMPTING TO DEFRAUD OR IN ANY WAY TAMPER WITH THIS scholarship WILL BE INELIGIBLE FOR PRIZES AND MAY BE PROSECUTED TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in their sole discretion, to cancel or suspend this scholarship should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the scholarship. Sponsor further reserves the right to modify the rules of the scholarship in any way or at any time, as long as reasonable notice is given.

Throughout our Site, we have provided links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites, or the information, products or services offered on or through the sites. In addition, neither we nor our parent or subsidiary companies nor any of our respective affiliates operate or control in any respect any information, products or services that third parties may provide on or through the Site or on websites linked to by us on the Site.

Service Limitations. We will do our best to make your experience on GKScholarship is a pleasurable one. However, we cannot always foresee or anticipate technical or other difficulties. These difficulties may result in loss of data, personalization settings or other service interruptions. For this reason, you agree that GKScholarship, including the services of our third party service providers, are provided "AS IS." GKScholarship and our third party service providers cannot assume responsibility for the timeliness, deletion, miss-delivery or failure to store any user data, communications or personalization settings.
Service Changes and Discontinuation. GKScholarship reserves the right to change or discontinue, temporarily or permanently, the Programs or Services at any time without notice. You agree that GKScholarship will not be liable to You or any third party for any modification or discontinuance of the Programs or Services.
Privacy Policy. GKScholarship respects your privacy and has developed a detailed Privacy Policy that is incorporated into this Agreement. Please take the time to read our Privacy Policy. By agreeing to these Terms, you are also accepting the terms of our Privacy Policy.
General Rules
For the benefit of the entire GKScholarship community, and to comply with applicable laws, we have a few mandatory guidelines that we call General Rules. We hope you will find them reasonable. Please understand, though, that any conduct that violates the General Rules is grounds for termination of your account. For this reason, we ask that you carefully read and follow them.
Provide Accurate Information. You agree to provide true, accurate, current and complete information about yourself as requested in the GKScholarship registration or other data forms (we call this information Registration Data). Accurate records help us create better experiences and provide us with opportunities to identify new services that may interest you.
Obey the Law. You agree not to use the service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous (untrue and damaging to others), invasive of another's privacy, abusive, threatening, or obscene, or that infringes the copyrights (rights of an owner of written material) or other intellectual property of others.
Content Restrictions. GKScholarship attempts to provide some of the very best content available on the web and make it available to you for your personal, non-commercial use. All design, text, graphics, the selection and arrangement thereof, and all software that are part of GKScholarship are protected by international copyright laws. The publication, sale, or redistribution in any form or medium of text, photos, graphics, audio and/or video materials or any other form of proprietary content found on GKScholarship is strictly prohibited without the prior written permission of GKScholarship. Content that is publicly available on GKScholarship may not be stored in a computer, except for personal and non-commercial use.

A). DISCLAIMER OF WARRANTIES. You expressly understand and agree that:

GKScholarship and its third party service providers expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
GKScholarship makes no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material obtained by you through the service will meet your expectations, (v) that your email messages will not be lost, and (vi) any errors in the software will be corrected.
Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk, and you will be solely responsible for any potential damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from GKScholarship, our third party service providers, or through or from the Service will create any warranty not expressly stated in the terms.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
To the extent that any part of this section is not consistent with any other part of these terms, then this Disclaimer of Warranties will override it.
B). NO ENDORSEMENT OF MEMBER CONTENT. You acknowledge and agree that GKScholarship does not endorse the content of any member and is not responsible or liable for any content, even though it could be unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable, or that it infringes or may infringe the intellectual property or other rights of another. You acknowledge that GKScholarship does not pre-screen all content, but that GKScholarship and its designees will have the right (but not the obligation) in their sole discretion to refuse, edit, move or remove any content that is publicly available via the service.
C). LIMITATION OF LIABILITY. You agree that GKScholarship will not be liable for any harms, which lawyers and courts often call direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if GKScholarship has been advised of the possibility of such damages), resulting from: (i) The use or the inability to use the service; (ii) The cost of getting substitute goods and services resulting from any products, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) Unauthorized access to or alteration of your transmissions or data; (iv) Statements or conduct of anyone on the service; or (v) Any other matter relating to the service.
D). INDEMNIFICATION. You agree to protect and fully compensate GKScholarship and its service providers from any and all third-party claims, liability, damages, expenses and costs (including, but not limited to, reasonable attorneys fees) arising from your use of the services, your violation of the terms or your infringement, or infringement by any other user of your account, of any intellectual property or other right of anyone.

GKScholarship provides information of a general nature and is designed for informational and entertainment purposes only and is not meant to be a substitute for medical, health, legal, or financial advice from a professional. Consult with your professional for any specific medical, health, legal, or financial concern.
GKScholarship's rights under this Agreement may not be waived unless GKScholarship agrees to such change in writing. This Agreement is personal to you and you may assign this agreement only with GKScholarship's prior written approval. Any other attempt to assign, transfer or delegate this Agreement shall be null and void.
All matters relating to your access to, or use of, the Service shall be governed by U.S. federal law or the laws of the State of California, excluding that body of laws known as conflicts of laws. If any provision of this Agreement is invalid or unenforceable under applicable law, it is, to that extent, deemed omitted and the remaining provisions will continue in full force and effect. Any notices related to this agreement need to be given in writing to one another at our address below, or any new address that is given in such a notice. This agreement is the entire understanding between you and GKScholarship about the services.
The parties have agreed that this Agreement shall be written in English.

We use the information you provide about yourself to administer our scholarship contest. We use your email addresses to answer the email we receive and if you opt-in to send you a monthly newsletter on paying for college. Also, if you opt-in to receive free access to the scholarship database your email address will be used as your username to access the database. We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such uses.
We gather additional data if you elect to engage with our sites or certain sites owned by our Media Partners. This includes contact information you elect to provide (e.g., name, address, email address, telephone number) about yourself or third parties to us and our Media Partners. In addition to contact information other types of information may include age, gender, occupation, college preferences and education level. The type and scope of the information we collect are based upon the services you are using or requesting.
With any of our affiliated companies (i.e., companies that control, are controlled by, or are under common control with us) for support of our internal and business operations ("Business Purposes") or for cross-marketing purposes ("Affiliate Marketing Communications"). You may not opt out of sharing of your Personal Information for Business Purposes, however you may opt out of Affiliate Marketing Communications as further described in this Policy.
With your consent we may share your Personal Information with Authorized Third Parties with whom we partner to provide contests, scholarships or services.

We use non-identifying and aggregate information to better design our website and to share with advertisers. For example, we may tell a partner that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our registration form, but we would not disclose anything that could be used to identify those individuals.

We may link to websites that are not owned and operated by us. We are not responsible for the content or practices of such websites, including their practices with respect to your data. We have no responsibility or liability for such practices, and such practices govern your use of those websites. If this site includes any mapping features, these mapping features are powered by Google, Inc. and governed by Google’s privacy policy, as amended from time to time.
